Terms of Service

By accessing or using Moyamap’s website, apps or related services, you agree to these Terms of Service. If you do not agree, please do not use Moyamap.

You must be at least 18 years old to create a creator account or to make purchases through the platform.

Moyamap is a platform operated by MoyaCode Limited (“Moyamap”, “we”, “us”) that enables travel creators to sell interactive, map-based journals to travellers. We provide the software and infrastructure; creators publish journal content; travellers discover and purchase access to that content.

You keep ownership of the content you create (including photos, tips, text and other materials you upload to your journals).

By publishing on Moyamap, you grant us a non-exclusive, worldwide licence to host, display, distribute, and promote your journal content within the platform and in reasonable marketing for Moyamap (for example, screenshots, previews or creator spotlights). This licence lasts while your content is on the service and for a reasonable period afterwards for archival or legal purposes.

You are responsible for ensuring your content is original (or properly licensed), truthful where it states facts, and does not infringe anyone else’s rights—including copyright, trade marks, privacy, publicity or other laws.

We may remove or restrict content that breaches these terms, applicable law, or our community standards.

Unless we agree otherwise in writing, revenue from journal sales is split 75% to the creator and 25% to the platform, calculated before app store commissions, taxes and payment fees unless stated otherwise in your creator tools.

Creator payouts are processed through Stripe (or another provider we specify), subject to identity checks, a minimum payout threshold, and our payout schedule as shown in the app or creator dashboard.

We do not withhold or remit taxes on your behalf unless required by law. You are responsible for your own tax reporting and payments on income you earn.

Journal purchases are digital content. Where you buy through our iOS app, delivery and billing may be handled by Apple In-App Purchase.

Refund requests for purchases made through Apple are handled under Apple’s policies. Moyamap does not operate a separate refund process for those Apple transactions.

Journals you purchase are for your personal, non-commercial use. You must not redistribute, resell, publicly republish, or share access outside what the product allows.

Your personal journal layer (for example photos and notes you add in the app) is stored locally on your device. We are not responsible for loss of that data if you lose, damage or reset your device, or if you uninstall the app without backing up.

You must not: scrape, crawl, reverse engineer, circumvent security, or use bots or automated tools to access the service except where we offer a documented API or written permission; upload malware or harmful code; post illegal, defamatory, harassing, hateful, or infringing content; impersonate a person or organisation; or interfere with other users or the operation of Moyamap.

We may suspend or terminate accounts that violate these rules or put the service or others at risk.

The Moyamap name, logo, and overall look and feel of the platform are owned by MoyaCode Limited. You may not use our branding without permission except as needed to identify the service in ordinary use.

Creator journal content remains the creator’s intellectual property, subject to the licence you grant us above.

Traveller-generated content you add for your own use (such as private notes or personal photos in your local journal layer) remains yours.

Moyamap is not a travel agency, booking service, or emergency service. Journal routes, tips and descriptions reflect creators’ experiences and opinions, not professional advice.

We do not guarantee the accuracy, safety, legality, or availability of any place or activity mentioned in a journal. You choose where to go and what to do at your own risk.

The service is provided “as is” without warranties of any kind, to the fullest extent permitted by law.

To the fullest extent permitted by law, Moyamap’s total aggregate liability for claims arising out of or related to these terms or the service (whether in contract, tort or otherwise) is limited to the greater of: (a) the total amount you paid to Moyamap for journal purchases in the twelve (12) months before the event giving rise to the claim; or (b) one hundred pounds sterling (£100), if (a) does not apply.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot legally be capped.

These terms are governed by the laws of England and Wales. Subject to mandatory consumer protections where you live, you agree that the courts of England and Wales have exclusive jurisdiction.

If you are a consumer in the United Kingdom, you have rights under the Consumer Rights Act 2015 in relation to digital content supplied to you, including that digital content must be of satisfactory quality, fit for a particular purpose you made known to us, and as described. Nothing in these terms affects those statutory rights.

We may update these Terms of Service from time to time. We will change the effective date at the top of this page. If you continue to use Moyamap after changes take effect, that use constitutes acceptance of the updated terms.

If we make material changes, we will notify you by email to the address associated with your account where we have one.
