Terms of Service

By accessing or using Moyamap’s website, app or related services, you agree to these Terms of Service. If you do not agree, please do not use Moyamap.

You must be at least 18 years old (or the age of majority where you live) to make purchases through the app.

Moyamap is a personal travel journal app for iOS, operated by MoyaCode Limited (“Moyamap”, “we”, “us”). It builds a private map of your trips from the photos on your device, so you can look back on where you have been. Moyamap is for your own personal use. It is not a social network, a marketplace, or a service for selling or sharing journals with others.

You need an account to use Moyamap. You are responsible for keeping your sign-in secure and for activity that happens under your account. Tell us promptly if you think your account has been compromised.

Moyamap is free to start, with a free first trip, and you can unlock further trips or features through paid in-app purchases.

Purchases are digital content bought through Apple In-App Purchase. Apple handles delivery and billing under your agreement with Apple.

Refund requests for purchases made through Apple are handled under Apple’s policies. Moyamap does not operate a separate refund process for those Apple transactions.

What you unlock is licensed to you for your personal, non-commercial use.

The map, photos, notes and trips you create are yours. Moyamap processes your photos on your device to build your map and does not upload them to our servers.

Because your journal is stored on your device, you are responsible for backing it up. We are not responsible for loss of that content if you lose, damage or reset your device, or if you uninstall the app without a backup.

We do not claim ownership of your content. You grant us only the limited permission needed to run the app for you (for example to display your own content back to you within the app). We do not publish, sell or share your content.

You must not: reverse engineer, circumvent security, or use bots or automated tools to access the service except with our written permission; upload malware or harmful code; use Moyamap for unlawful purposes; infringe anyone else’s rights; or interfere with other users or the operation of Moyamap.

We may suspend or terminate accounts that violate these rules or put the service or others at risk.

The Moyamap name, logo, and overall look and feel of the app are owned by MoyaCode Limited. You may not use our branding without permission except as needed to identify the service in ordinary use. Your own content (your photos, notes and the journals you build) remains yours, as set out above.

Moyamap is not a travel agency, booking service, or emergency service. It helps you record and revisit your own trips; it does not provide professional travel advice. Map data and place information are provided by third parties and may be incomplete or inaccurate. The service is provided “as is” without warranties of any kind, to the fullest extent permitted by law.

To the fullest extent permitted by law, Moyamap’s total aggregate liability for claims arising out of or related to these terms or the service (whether in contract, tort or otherwise) is limited to the greater of: (a) the total amount you paid to Moyamap for in-app purchases in the twelve (12) months before the event giving rise to the claim; or (b) one hundred pounds sterling (£100), if (a) does not apply.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot legally be capped.

These terms are governed by the laws of England and Wales. Subject to mandatory consumer protections where you live, you agree that the courts of England and Wales have exclusive jurisdiction.

If you are a consumer in the United Kingdom, you have rights under the Consumer Rights Act 2015 in relation to digital content supplied to you, including that digital content must be of satisfactory quality, fit for a particular purpose you made known to us, and as described. Nothing in these terms affects those statutory rights.

We may update these Terms of Service from time to time. We will change the effective date at the top of this page. If you continue to use Moyamap after changes take effect, that use constitutes acceptance of the updated terms. If we make material changes, we will notify you by email to the address associated with your account where we have one.
